Ninth Anniversary of Amazon 1-Click Injunction

theodp writes “Nine years ago Monday, Amazon kicked off the Holiday Season by slapping Barnes and Noble with a court injunction barring BN from using a checkout feature that Amazon said represented illegal copying of its patented 1-Click technology. ‘We’re pleased that Judge Pechman recognized the innovation underlying our 1-Click feature,’ said Jeff Bezos in a press release. But an Appellate Court wasn′t quite as impressed with Amazon’s innovation. Nor were USPTO Examiners who were asked to take another look at the merits of Amazon’s 1-Click patent claims. Still, 1-Click lives on, although Amazon’s lawyers are currently fighting two separate rejections by USPTO Examiners, burying USPTO Examiners in paper, and employing canceling-and-refiling tactics that some may find reminiscent of Eddie Haskell’s chess end-game strategy. So much for Amazon-led patent reform.”

FTC Pursues Rambus Appeal To Supreme Court

pheede writes “SCOTUSblog brings us news that the FTC has appealed the recent circuit court decision regarding Rambus’s deceptive conduct on the JEDEC standards committee, where they conveniently avoided telling anyone that they owned patents on the resulting standards. The FTC, which is proceeding on its own without help from the Justice Department, notes the circuit court’s ’sweeping rules that would immunize’ deceptive conduct by would-be monopolists ‘in most circumstances.’”

Apple Sued Over IPhone Browser

SpuriousLogic writes “A Los Angeles real estate developer is suing Apple for patent infringement over the way the iPhone navigates Web sites. The suit, which was filed on behalf of EMG Technology, seeks unspecified damages. EMG Technology is a company that holds the patents of Elliot Gottfurcht, the real estate developer, as well as Marlo Longstreet and Grant Gottfurcht. The company claims that the iPhone infringes on patent 7, 441, 196- a patent that was approved only last month, after a filing process that began on March 13, 2006. That patent is for an invention that displays ‘on-line content reformatted from a webpage in a hypertext markup language (HTML) format into an extensible markup language (XML) format to generate a sister site.’ This sister site is a simplified version of the original site that is then displayed on any number of devices–including cell phones, EMG says.”

IBM’s But-I-Only-Got-The-Soup Patent

theodp writes “In an Onion-worthy move, the USPTO has decided that IBM inventors deserve a patent for splitting a restaurant bill. Ending an 8+ year battle with the USPTO, self-anointed patent system savior IBM got a less-than-impressed USPTO Examiner’s final rejection overruled in June and snagged U.S. Patent No. 7,457,767 Tuesday for its Pay at the Table System. From the patent: ‘Though U.S. Pat. No. 5,933,812 to Meyer, et al. discussed previously provides for an entire table of patrons to pay the total bill using a credit card, including the gratuity, it does not provide an ability for the check to be split among the various patrons, and for those individual patrons to then pay their desired portion of the bill. This deficiency is addressed by the present invention.’”

Rewriting a Software Product After Quitting a Job?

hi_caramba_2008 writes “We are a bunch of good friends at a large software company. The product we work on is under-budgeted and over-hyped by the sales drones. The code quality sucks, and management keeps pulling in different direction. Discussing this among ourselves, we talked about leaving the company and rebuilding the code from scratch over a few months. We are not taking any code with us. We are not taking customer lists (we probably will aim at different customers anyway). The code architecture will also be different — hosted vs. stand-alone, different modules and APIs. But at the feature level, we will imitate this product. Can we be sued for IP infringement, theft, or whatever? Are workers allowed to imitate the product they were working on? We know we have to deal with the non-compete clause in our employment contracts, but in our state this clause has been very difficult to enforce. We are more concerned with other IP legal aspects.”

McDonalds Files To Patent Making a Sandwich

I Don’t Believe in Imaginary Property writes “McDonalds has applied for patent WO2006068865, which carries the title ‘METHOD AND APPARATUS FOR MAKING A SANDWICH.’ John Montagu, the fourth Earl of Sandwich, can eat his heart out (unless that’s been patented, too). Undoubtedly, some people are contemplating whether there’s anything novel in this patent that is somehow obscured by its generic title. Feel free to examine their flowchart for yourself and see exactly how novel their sandwich ’subroutines’ are. The good news is that, given that it only mentions generic sandwich making ‘tool(s),’ rather than any specific machine, it might not survive after the In Re Bilski decision, which was meant to put a stop to absurdities such as this. But until McDonalds’s application is rejected or invalidated, make sure you don’t use their flowchart when making sandwiches. After all, if you ‘apply appropriate condiments to appropriate compartment,’ you might infringe upon their IP.”

Startup Seeks To Preempt Patent Trolls

anaesthetica writes “The WSJ reports that a San Francisco startup is buying up patents with the promise never to assert them in order to help large corporations hedge against patent trolling firms. The company, RPX Corp, receives an annual fee in exchange for licensing the patents it has purchased. Cisco and IBM have already signed up for this service of ‘defense patent aggregation.’”

Groklaw Says Microsoft Patent Portfolio Now Worthless

twitter writes “P.J. concludes her look at the Bilski decision: ‘you′ll recall patent lawyer Gene Quinn immediately wrote that it was bad news for Microsoft, that “much of the Microsoft patent portfolio has gone up in smoke″ because, as Quinn’s partner John White pointed out to him, “Microsoft doesn’t make machines.” Not just Microsoft. His analysis was that many software patents that had issued prior to Bilski, depending on how they were drafted, “are almost certainly now worthless.” … He was not the only attorney to think about Microsoft in writing about Bilski.’”

Crowdsourcing Site Offers Rewards To Bust Patents

The company’s founder told New Scientist she thought the initiative would improve ‘patent quality’ by increasing scrutiny on poor patents. She aims to profit by selling the information contributors collect, or trade stocks based on it. Current patents they are looking for help to bust include those being used by Konami to sue Harmonix over Rock Band and Guitar Hero.”

Some Schools Welcoming Patent Firm, Others Wary

theodp writes “Intellectual Ventures (IV) will be setting up shop at the top of a Four Seasons this week as Headline Sponsor of the Ready to Commercialize 2008 conference hosted by the University of Texas at Austin. It’s the patent firm’s 100th university deal, though some, such as Professor Michael Heller at Colombia University, warn against such deals. ‘… their individual profit comes at the cost of the public ability to innovate. The university’s larger mission is to serve the public interest, and some of these deals work against that public interest.’ It’s a follow-up to the conference IV sponsored last summer for technology transfer professionals entrusted with commercializing their universities’ intellectual property, and should help IV, a friend of Microsoft, snag even more exclusive deals (PDF).”

If you haven’t been reading On Rad’s Radar, you should. This TMC blog is written by Peter Radizeski the CEO of Rad-Info, Inc. Let me take an excerpt from his bio.

Cisco AutoQoS Enables Easy VoIP QoS

cisco-logo.gifSaw a good article on Enterprise Networking Planet about AutoQoS, a new Cisco IOS command to make provisioning QoS on your router much simpler — much more plug-n-play. With time-sensitive (latency, jitter) apps such as VoIP, QoS is critical. How simple is turning on AutoQoS? Well, to turn on QoS on your WAN interface, you just type this:

AutoQoS is a new IOS feature for Cisco routers that Cisco decided to add when it realized it needed to simplify the complexity of QoS for their customers. AutoQoS can be enabled on both WAN links and Ethernet switches to automatically provide VoIP traffic prioritization.

Barco demoes 10MP 3D stereo CADWall setup

Barco has a knack for stopping shows, and while Tokyo’s Industrial Virtual Reality expo didn’t exactly shut down, we can only imagine how many folks took the time to check out the CADWall concept. Hailed as a “multi-channel display system with a high pixel density that consists completely of Barco technology,” said system utilizes a pair of LX-5 projectors, a superflat high-contrast screen and just two-channels to create a 10-megapixel 3D stereo image. Sure beats six or eight to make the third-dimension come to life, huh?
